Brown Mogotsi Denied Bail

North West businessman and political fixer Brown Mogotsi remains in custody after the Johannesburg Magistrate Court repeatedly turned down his applications for release on bail. Mogotsi faces serious criminal charges, including unlawful possession of a firearm and ammunition, discharging a firearm in a public place, defeating the ends of justice, and perjury.

The legal proceedings stem from allegations that Mogotsi staged an assassination attempt on himself in Vosloorus. He initially reported to law enforcement that unknown gunmen had ambushed his vehicle. However, forensic analysis and ballistic tests conducted by the state revealed that eleven spent cartridge casings were recovered from a stationary, unoccupied car. Further investigation linked the weapon used at the scene to other separate criminal cases.

In the initial bail judgment, the magistrate determined that releasing Mogotsi would not serve the interests of justice. The presiding officer highlighted concerns regarding a lack of verifiable residential information, noting that multiple addresses provided to investigators failed to correspond. This discrepancy raised significant flight risk concerns and led the court to conclude that tracing him would prove difficult if he were granted liberty.

A subsequent attempt to secure bail based on new facts was also rejected by the magistrate. The court ruled that the supplementary affidavits submitted by Mogotsi did not meet the legal threshold for new evidence, describing the material as a simple restructuring of facts that had already been evaluated during the first application. Additionally, state prosecutors raised serious allegations concerning attempts to contact or intimidate a state witness during his period of detention. Consequently, Mogotsi was remanded in custody while awaiting formal trial proceedings.
